Tinjauan Maqashid Al-Syariah Terhadap Undang-Undang No.8 Tahun 1999 Tentang Perlindungan Konsumen


Abstract
Maqashid al-sharia aims to create benefit and prevent loss in fulfilling basic human needs, namely by protecting religion, soul, mind, descent and property. Law Number 8 of 1999 concerning Consumer Protection (UUPK) is expected to be able to develop a complete human being by creating fair trading business activities for consumers and business actors, so that basic human needs are met. Maqashid al-sharia and UUPK both have the goal of benefit and aspects of protection of fundamental human rights. The concept of maqashid al-sharia has indirectly been realized in the articles of the UUPK in the form of fulfilling rights and obligations as a manifestation of attracting benefit for consumers and business actors, while actions that are prohibited by business actors are to prevent consumer losses.

Abstrak
Maqashid al-syariah bertujuan mewujudkan kemashlahatan dan mencegah kerugian dalam pemenuhan kebutuhan pokok manusia yaitu dengan melindungi agama, jiwa, akal, keturunan dan harta. Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK) diharapkan mampu membangun manusia seutuhnya dengan menciptakan kegiatan usaha perdagangan yang fair bagi konsumen dan pelaku usaha, sehingga kebutuhan pokok manusia terpenuhi. Maqashid al-syariah dan UUPK sama-sama memiliki tujuan kemashlahatan dan aspek perlindungan terhadap hak-hak fundamental manusia. Konsep maqashid al-syariah secara tidak langsung telah direalisasikan dalam pasal-pasal UUPK berupa pemenuhan hak dan kewajiban sebagai perwujudan menarik kemashlahatan bagi konsumen dan pelaku usaha, sedangkan perbuatan yang dilarang bagi pelaku usaha untuk mencegah kerugian konsumen.
