Pemisahan Uus Buk dan Implikasinya Terhadap Hubungan Antara Entitas Konvensional dan Syariah


Abstract
The main consideration of sharia business unit-commecial bank (SBU-CB) spin-off, i.e. to increase the public trust to sharia banking institution. The spin-off SBU-CB could be done by two ways, i.e. (1) establishing new sharia commercial bank (SCB); or (2) transferring right and obligation of SBU into the existing SCB. The spin-off SBU-CB’s into SCB’s are not completly reach the purpose of spin-off, to terminate the existence of SBU in Indonesia legal system and to create SCB as separate legal entity, that focus and independent in the field of sharia business activity, because the operation of SCB under the CB supervise.

Abstrak
Pertimbangan utama dilakukannya pemisahan UUS dari BUK yakni dalam rangka meningkatkan kepercayaan masyarakat terhadap lembaga perbankan syariah. Pemisahan UUS dari BUK dapat dilakukan dengan dua macam cara, yaitu: (1) mendirikan BUS baru; atau (2) mengalihkan hak dan kewajiban UUS kepada BUS yang telah ada. Pemisahan UUS BUK ke dalam BUS, belum sepenuhnya mampu mewujudkan cita ideal dilembagakannya Pemisahan, yakni untuk mengakhiri keberadaan UUS dalam sistem hukum perbankan Indonesia dan menciptakan BUS sebagai separate legal entity yang fokus dan independen dalam mengelola aktivitas bisnis berdasarkan prinsip syariah, karena dalam kenyataannya operasional BUS hasil pemisahan masih dalam bayang-bayang BUK selaku induk-nya.
