Abstract

Bank crime is increasing nowadays, the modus operandi is becoming more sophisticated. In fact, in some cases, involved in mafia syndicates, both from within and from abroad. This research discusses the forms of banking crime based on Law no. 10 of 1998 concerning Banking and the duties and authorities of the Financial Services Authority (OJK) in handling banking crimes in Indonesia. The formation of the OJK in Indonesia was based on a desire from the government to implement regulations in terms of supervision in the financial services sector, especially in the banking sector which is starting to weaken. With the formation and enactment of the OJK Law, it has provided legal certainty and has become the legal basis for OJK to carry out its duties.

Abstrak

Kejahatan bank makin meningkat dewasa ini, modus operandinya pun makin canggih. Bahkan, dalam beberapa kasus, terlibat sindikat mafia, baik dari dalam maupun dari luar negeri.  Penelitian ini membahas bentuk-bentuk tindak pidana perbankan berdasarkan Undang-Undang No. 10 tahun 1998 tentang Perbankan dan tugas dan wewenang Otoritas Jasa Keuangan (OJK) dalam menangani tindak pidana perbankan di indonesia. Terbentuknya OJK di Indonesia didasari dengan suatu keinginan dari pemerintah untuk melakukan regulasi dalam hal pengawasan di sektor jasa keuangan terutama dalam sektor perbankan yang mulai melemah. Dengan terbentuk dan berlakunya UU OJK telah memberikan kepastian hukum dan telah menjadi dasar hukum bagi OJK untuk melakukan tugas dari lembaga tersebut.
